Modern Tiles and Floor Pty Ltd (ABN 79 701 942 001) is a Western Australian company supplying tiles and providing flooring services throughout Perth, WA. These terms apply to all quotations, supply of materials, and installation or related services we provide, unless otherwise agreed in writing.

2. Quotations and Estimates

Quotations issued by us are valid for 30 days from the date of issue unless stated otherwise. Quotations are based on the information available at the time, including site conditions, measurements, and materials selected. Where site conditions differ from what was assumed, or where additional work is required, we will advise you of any variation and obtain your approval before proceeding. Estimated timeframes are indicative only and may be affected by material availability, weather, and other factors beyond our reasonable control.

3. Supply of Tiles and Materials

Tile and material samples are representative only. Natural stone, ceramic, and porcelain products may vary in colour, shade, texture, and pattern between batches. We recommend ordering sufficient quantities for your project, including wastage, at the same time, as matching batches cannot be guaranteed for later orders. Title in goods supplied passes to you upon full payment. Risk passes to you upon delivery to the site or collection from our supplier.

4. Payment Terms

Unless otherwise agreed in writing, a deposit is required to confirm bookings and order materials, with the balance payable upon completion of works. Overdue accounts may attract interest and reasonable recovery costs. We will provide tax invoices compliant with Australian Taxation Office requirements.

5. Access and Site Conditions

You agree to provide safe and reasonable access to the worksite at agreed times, including power and water where required for installation works. You are responsible for disclosing any known site hazards, including asbestos or structural issues. Where concealed conditions are discovered that could not reasonably have been identified, we will pause work and discuss options and any cost implications with you before continuing.

6. Workmanship Warranty

We warrant our installation workmanship against defects for a period of 7 years from completion, subject to fair wear and tear, proper use, and compliance with any care instructions we provide. This warranty is in addition to, and does not limit, your rights under Australian Consumer Law.

7. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law or other applicable legislation.

8. Liability

To the extent permitted by law, our liability for any claim arising from our services is limited to the value of the works undertaken, except where the Australian Consumer Law provides otherwise. We are not liable for damage arising from misuse, inadequate maintenance, movement or defects in the underlying substrate or structure, or works performed by others.

9. Cancellations

If you cancel a confirmed booking, reasonable costs already incurred, including ordered materials and scheduling commitments, may be payable. We will always provide a breakdown of any applicable cancellation charges. If we need to reschedule, we will give you as much notice as practicable and work with you to find a suitable alternative.
